BISPHENOL-A: restriction on the use in Canada & United States

In Canada and in several states, the concern about the risk associated to the exposure of children to Bisphenol-A (BPA) is growing.

Suffolk County (New York) has recently banned BPA from children’s beverage containers used by children under the age of three years. The ban applies to both products placed on the market and sold or offered for sale. Therefore even retailers have some duties since the law prohibits them to sell products containing BPA.

Members of US Senate and House of Representative have recently proposed a law, also renamed “Ban Poisonous Additives Act of 2009”, that ban the use of BPA in every reusable container for food and beverages. The proposal is still under evaluation of the House and Senate and, therefore, has not yet entered into force.

These initiatives derive from a decision, undertaken on the first days of March, by some of the most important companies that manufacture baby bottles and other containers for children to ban the use of Biphenol-A from the production of articles.

Canada, on 6 February 2009, has passed a proposal that in 6 months from its official approval will ban the BPA in multiple products, among which:

  • Food and drink packaging, including food cans, beverages can, bottle tops and plastic containers for beverages, including bottle water
  • Products designed to feed infants, including feeding bottles, sippy cups and other similar products
  • Reusable containers for food and beverages intended for recreational outdoor use.
